This Agreement contains the terms governing your use of this site and the terms which govern all mysafeharbour user accounts. When you use the mysafeharbour site and open a mysafeharbour account, you agree to be bound by all of the terms of this Agreement. All references to "we", "us" or "our" refer to mysafeharbour. The terms are as follows:

1. Age Restriction: The Mysafeharbour site is intended for use by individuals 18 years of age or over. If you are under 18 years of age, you may view our site, but you cannot open an account with Mysafeharbour.

2. Privacy: Our Privacy Policy is part of this Agreement. IF YOU HAVE NOT READ THE PRIVACY POLICY, PLEASE DO SO NOW BY CLICKING HERE. You accept all of the terms of the Privacy Policy. You acknowledge that the Privacy Policy permits Safe Harbour Security, amongst other things, to maintain in the Mysafeharbour Registry, in perpetuity, certain personal information that you provide to us in association with the items that you register with Mysafeharbour. You also acknowledge that we may provide information about you to suppliers of items you register with Mysafeharbour, who may use this information for marketing purposes. Such suppliers include manufacturers, sellers, agents and dealers of the item or items you register with Mysafeharbour.

3. Payment for Services: Unless otherwise quoted, all Mysafeharbour fees are in U.S. dollars. You agree to pay MySafeharbour fees and applicable taxes in accordance with our fee schedule, which may change from time to time. Safe Harbour Security shall have no obligation to provide you with any services unless we receive payment in advance, or authorization for payment satisfactory to us. Upon any failure to make payment in respect of any transaction, we may terminate your Mysafeharbour account and we may (at our option) remove any information from the Mysafeharbour Registry that you have provided to Mysafeharbour, in relation to all transactions you have made with Safe Harbour Secruity at any time.

4. Accuracy and Quality of Information you Provide to Safe Harbour Security: You guarantee that all of the information you provide to Safe Harbour Security is accurate. You may not submit or post any information or images with Mysafeharbour that may be illegal, harmful, defamatory, fraudulent, racist, profane, pornographic, or otherwise objectionable, as we determine in our sole discretion. If we determine that you have breached this paragraph in any way, we may terminate your Mysafeharbour account and/or remove any information and images you have provided to us from our site and the Mysafeharbour Registry, in relation to all transactions you have made with Safe Harbour Security at any time.

5. Access and Operation of Mysafeharbour: We strive to ensure uninterrupted access to the Mysafeharbour site at all times by providing 24/7 service, a fault tolerant system, continual monitoring and back-up procedures and industry standard disaster recovery processes and procedures, but due to the complexities of Internet communication, we do not guarantee that access will be uninterrupted or error free. We shall fix any problems as quickly as we can. The address of this site may be changed and all information may be transferred to a new site.

6. Warranty Claims and Warranty Limitations:

(1) Mysafeharbour's Registry provides a method for you to record ownership of personal items and valuables.

(2) EXCEPT AS SPECIFIED IN THIS PARAGRAPH, SAFE HARBOUR SECURITY PROVIDES NO WARRANTIES, EXPRESS OR IMPLIED, FOR SAFE HARBOUR SECURITY PRODUCTS OR SERVICES OR THE OPERATION OF THIS SITE, AND ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED. SAFE HARBOUR SECURITY ALSO OFFERS NO WARRANTIES OR REPRESENTATIONS AS TO THE QUALITIES, USES OR SAFETY OF ANY ITEMS YOU MAY REGISTER WITH SAFE HARBOUR SECURITY.

7. LIMITATION OF LIABILITY: EXCEPT AS SPECIFIED IN THE WARRANTIES PARAGRAPH ABOVE, THE TOTAL AMOUNT OF ANY CLAIMS YOU MAY MAKE AGAINST SAFE HARBOUR SECURITY AND SAFE HARBOUR SECURITY'S DIRECTORS, OFFICERS, EMPLOYEES, AND AFFILIATE DEALERS, BY NEGLIGENCE, CONTRACT OR OTHERWISE, IS LIMITED TO THE SUM OF ALL FEE PAYMENTS MADE BY YOU TO SAFE HARBOUR SECURITY, WHETHER SUCH CLAIMS ARE FOR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL OR OTHER DAMAGES. IF THE LIMITATIONS OF THIS PARAGRAPH ARE RESTRICTED OR REDUCED BY LAW, THIS PARAGRAPH SHALL APPLY TO THE MAXIMUM EXTENT PERMISSIBLE BY LAW. SOME JURISDICTIONS MAY NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

8. Law of this Agreement and forum for claims against Safe Harbour Security: This Agreement shall be exclusively governed by the laws of Nova Scotia, Canada without regard to conflict of laws. All claims against Safe Harbour Security are subject to the exclusive jurisdiction of the courts of Nova Scotia, but if you violate or threaten to violate our intellectual property or other rights in any way, we may commence legal proceedings in any location against you to protect Safe Harbour Security's rights.

9. Safe Harbour Security's ownership of intellectual property: The copyright in all materials shown at this site is owned solely by Safe Harbour Security. The trademarks shown at this site are also owned by or licensed to Safe Harbour Security. You may view and make a copy of the materials on this site for your personal records and non-commercial use, but no materials on this site may otherwise be copied, distributed, communicated, or used in any form or manner without the written permission of Safe Harbour Security. One or more patents are pending for the Authentication Verification Method used by Safe Harbour Security in association with this site.

10. Termination: We may terminate this Agreement and your Mysafeharbour account if (a) you breach the terms of this Agreement; (b) you engage in any harmful, illegal or fraudulent activity in relation to this site or Safe Harbour Security; or (c) we are unable to authenticate any information you provide to us. If such termination occurs, we shall have the option of removing any information and images in the Mysafeharbour Registry that you have provided to us, in relation to all transactions you have made with Safe Harbour Security at any time.

11. General Matters: You may not assign or transfer this Agreement in any way. Any parts of this Agreement found invalid by a court or tribunal shall be severed leaving the balance of the Agreement in force. This Agreement (including the Privacy Policy) is the entire agreement between you and Safe Harbour Security.
